Start a 1031 Exchange Checklist

Gather the property, contract, title, escrow, entity, advisor, lender, and deadline information for an initial 1031 exchange review.

Prepare for the first exchange review

Start before the sale or purchase closes. Gather the facts that show the property sequence, ownership, funds, and time limits.

1. Record the important dates

  • Record the expected relinquished-property closing date.
  • Record the expected replacement-property closing date.
  • Record the date of each completed property transfer.
  • Record the start date of each active identification period.
  • Record the start date of each active exchange period.
  • Record the federal tax-return due date and extension status.

2. Collect the property information

  • Give the address of each relinquished property.
  • Give the address of each proposed replacement property.
  • State how the taxpayer uses each property.
  • State if a related person is part of the transaction.
  • State if construction or improvement work is necessary.

3. Collect the contracts and title records

  • Collect the signed sale contract and all amendments.
  • Collect the signed purchase contract and all amendments.
  • Collect the available preliminary title report.
  • Identify the current owner of each property.
  • Identify the proposed owner of each replacement property.

4. Identify the transaction team

  • Give the escrow or title contact.
  • Give the real estate broker contact.
  • Give the tax advisor contact.
  • Give the attorney contact.
  • Give the lender contact.
  • Give the insurance contact for a reverse or improvement exchange.

5. Describe the exchange path

  • State if the sale will occur before the purchase.
  • State if the purchase can occur before the sale.
  • State if a buyer delayed or canceled the sale.
  • State if improvements must occur before property receipt.
  • State if the taxpayer has selected replacement property.

6. Review ownership and entity facts

  • Give the full taxpayer name.
  • Give the name on the current title.
  • Identify each limited liability company, partnership, trust, or corporation.
  • State if an ownership change is planned.
  • Ask the tax advisor and attorney to review the taxpayer identity.

7. Review funds and financing

  • State the expected sale price.
  • State the expected replacement-property price.
  • State the approximate debt on each property.
  • Identify the source of purchase and construction funds.
  • Give the loan status and lender requirements.

Do not put account numbers, wire instructions, or tax identification numbers in the website form.

8. Send the first message

Give a short description of the transaction. Include the next closing date and the requested service path.

Use one of these descriptions:

  • I am selling first and need a Qualified Intermediary.
  • I am buying first and need a reverse-exchange review.
  • I need an improvement-exchange review.
  • My sale failed or moved to a later date.
  • My 45-day or exchange deadline is active.
  • I am an advisor or closing professional for the taxpayer.
